Class-Action WaiverClass-Action Waiver
Any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Class arbitrations, class actions, private attorney general actions, and consolidation of your dispute with other arbitrations are not permitted and are waived by you.
If a court finds that the class-action waiver is unenforceable as to some parts of a dispute, those parts will be severed and proceed in a court of law, with the remaining parts proceeding in arbitration. If any other provision of this dispute resolution section is found to be illegal or unenforceable, that provision will be severed with the remainder of this section in full force.
Governing LawGoverning Law
Any claim or dispute arising out of or relating to this Agreement shall be governed by the laws of the State of Illinois, without respect to conflict of law provisions. You agree to submit to the personal jurisdiction and venue of the state and federal courts located in Cook County, Illinois.
PLEASE NOTE THAT BY AGREEING TO THIS USER AGREEMENT, YOU ARE: (1) WAIVING CLAIMS THAT YOU MIGHT OTHERWISE HAVE BASED ON THE LAWS OF OTHER JURISDICTIONS, INCLUDING YOUR OWN; (2) IRREVOCABLY CONSENTING TO THE EXCLUSIVE JURISDICTION OF STATE OR FEDERAL COURTS IN COOK COUNTY, ILLINOIS OVER ANY DISPUTES OR CLAIMS; AND (3) SUBMITTING YOURSELF TO THE PERSONAL JURISDICTION OF COURTS IN COOK COUNTY, ILLINOIS FOR THE PURPOSE OF RESOLVING SUCH DISPUTES OR CLAIMS.
General Provisions
Severability. If any provision of this Agreement is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision will be severed from the rest of the Agreement.
Assignment. We may assign this contract at any time without notice to you. You may not assign this contract to anyone else.
Acceptance. Registrations, agreements, and terms presented to you electronically have the same effect as a written, signed agreement and are legally enforceable. You also consent to receive all communications regarding the Website electronically from us.
Effectiveness of Communication. Delivery of any communication from us is effective when sent, regardless of when you receive or read it. We are not responsible for communications that do not reach you if you have not provided current contact information.
Release of Information. We may be required by law to release information about your account, including email content. Except as prohibited by law, we will send you notice if we plan to comply with a civil subpoena related to your account. You agree to hold us harmless for any release of information in connection with a civil subpoena.
Non-Waiver. If we do not enforce any right or provision in this Agreement, that is not to be deemed a waiver of our right to do so in the future.
Entire Agreement; Amendment. This Agreement is the entire agreement between you and us concerning the Website and supersedes all prior or contemporaneous agreements. We may modify this Agreement at any time. If we make material changes to your rights, we will provide advance notice and keep the prior edition available. Your continued use of the Website after any change constitutes your agreement to those changes.
Notices. If you have an issue or dispute, you agree to raise it and try to resolve it with us informally first. Contact us using the information on our Website.
